Changing a last name after marriage is one of the most common name change searches in California. In many cases, a spouse can use a certified marriage certificate instead of filing a separate court name-change case, but the new name usually must have been selected through the marriage-license process before the wedding.

Can You Change Your Name Through Marriage in California?
Yes, if the new middle or last name is an option allowed by California law and you list it on the marriage license application before the marriage. After the ceremony and registration, the certified marriage certificate becomes the legal evidence used to update identity records.
California Courts warns that you cannot add a new name to the marriage license after you are already married. If the desired name was not selected on the license, you will generally need the regular court name-change process.
What Names Can You Choose?
California allows certain marriage-related middle and last-name combinations, such as taking a spouse’s last name, using a birth surname, or combining qualifying surnames. A completely unrelated new name or a first-name change generally requires a court order.
Because the exact permitted combinations are technical, confirm the desired name with the county clerk before the license is issued.
Step 1 – Get Certified Marriage Certificates
After the marriage is registered, order certified copies of the marriage certificate from the county recorder or other authorized records office. Many agencies require a certified copy rather than a photocopy.
Step 2 – Update Social Security
The Social Security Administration changes your name by processing a replacement Social Security card. Depending on your situation, you may be able to complete the request online or may need an appointment. SSA states that replacement cards are typically mailed after the request is completed.
Updating Social Security early helps other agencies verify the new name.
Step 3 – Update California DMV
California DMV requires name changes for a driver license or identification card to be processed at a DMV office. Start a new application online before the visit when instructed by DMV. Bring the identity and legal name-change documents required for your transaction.
Step 4 – Update Passport and Other Records
Update your U.S. passport using the applicable State Department process, then move through payroll, banks, credit cards, insurance, retirement accounts, professional licenses, voter registration, vehicle title and registration, utilities, and other records.
Each agency controls its own evidence requirements. The marriage certificate changes your legal name evidence; it does not automatically update every record.
What If You Did Not Put the New Name on the Marriage License?
If the new name was not included before marriage, California Courts states that you cannot add it to the marriage certificate afterward. You will likely need to file an adult name-change petition with the superior court. That process can involve a filing fee, publication requirements, and a decree changing name.
Marriage Name Change vs Court Name Change
The marriage route is usually simpler because it relies on the marriage certificate. A court name change produces a separate decree. The correct route depends on whether the desired name was validly selected on the marriage license and whether the requested change falls within the marriage-name rules.
