What Is a Probate Guardianship?
A probate guardianship is a court arrangement in which an adult who is not the child’s parent becomes legally responsible for the child because a parent is unable to care for the child. The court remains involved while the guardianship is in effect.
If Child Protective Services removed the child and the case is in juvenile dependency court, different guardianship rules apply.
Guardianship of the Person vs Estate
A guardian of the person is responsible for the child’s care and major decisions, including housing, school, medical care, and safety. A guardian of the estate manages substantial money or property belonging to the child. Guardianship of the estate has strict fiduciary rules and often warrants legal help.
When Guardianship May Be Needed
California Courts gives examples such as a parent having a serious illness, needing treatment for substance abuse, being deployed or away for work, being incarcerated, or having a history of abuse. Guardianship is not the only option. In some families, a caregiver authorization or another arrangement may be sufficient when there is parental cooperation and no safety problem.
Where to File
Guardianship cases are usually filed in the county where the child lives, generally in probate court, though some courts assign them differently. If there is already another custody-related case involving the child, filing location can be affected.
Main Forms
For guardianship of the person, California Courts identifies GC-210(P), Petition for Appointment of Guardian of the Person, and GC-210(CA), Guardianship Petition – Child Information Attachment, as core forms. Additional forms address notice, consent, duties, orders, and letters of guardianship.
If the petitioner also seeks guardianship of the estate, the form set changes and legal assistance is often advisable.
Filing Fees and Fee Waiver
California Courts currently lists about $225 to start a guardianship of the person in most counties. Guardianship of the estate, or of both person and estate, has a higher filing fee, and statewide or county schedules can change. Check the current California Courts guardianship page and the filing court for the exact amount. Fee-waiver eligibility in a guardianship is based on the child’s financial circumstances, not the proposed guardian’s income.
Notify Parents and Family
After filing, the petitioner must give formal notice to the child’s parents and other relatives. California Courts lists the child if age 12 or older, parents, legal custodians, nominated guardians, grandparents, siblings, and certain other people among those who may need notice. Different recipients may require different service methods.
Court Investigation
The court appoints an investigator who reviews why guardianship is requested, meets with relevant people, conducts background checks, and prepares a report for the judge. The judge considers the report along with evidence and any objections.
The Hearing
At the hearing, the petitioner, parents, and other interested family members can be heard. The judge decides whether appointing the proposed guardian is appropriate. A parent can agree or object, and consent does not prevent the parent from later changing position before the court acts.
Temporary Guardianship
If a child needs protection or care before the regular guardianship hearing, a temporary guardianship may be requested. Temporary cases have additional forms, notice requirements, and tighter timing. Emergency facts should be described accurately and not exaggerated.
Duties After Appointment
A guardian of the person is responsible for the child’s care and must follow court orders. California Courts states that guardians file a Confidential Guardianship Status Report, GC-251, every year. Moving also triggers notice requirements, and moving the child out of California requires court permission first.
How Guardianship Ends
Guardianship can end when the child turns 18, when another legal event ends it, or when the court terminates it. A parent who becomes able to care for the child again can ask the judge to end the guardianship. Guardianship is therefore different from adoption, which permanently changes parental rights.
